Fa. GSTW: Betrüger / swindlers / oplichters!

We ordered and prepaid lamps from Lampen & Leuchten Online Shop / GSTW / EIB - KNX Online shop (German firm) on 1. january 2007 and never received them. After contacting the German police it became clear we were not the only ones who had problems with GSTW. Luckily the very helpful German police is actively helping to get our money back! 
Update 10/2008: We got our money back, but these shameless people are still in business and victims are numerous (see comments on this post)! When you contact the police they tend to give money back or send you the products after all. Please use this form to directly contact the appropriate authorities: Polizei Viechtach.

Dutch extended version
Na vele producten via Internet te hebben aangeschaft, moet het natuurlijk ook een keer misgaan. Begin januari bestelden wij 3 designlampen bij de website Lampen & Leuchten Online Shop van de firma GSTW in Duitsland. Gezien de vele goede ervaringen met Duitse webbedrijven en na deze leverancier te hebben ge-Googled, het bedrag per bank overgeschreven.

Contactpogingen
In de periode hierna stuur ik regelmatig e-mails om te informeren of het geld ontvangen is en levering in het vooruitzicht is. Aangezien ik geen enkele reactie ontvang, besluit ik ze te bellen. Een antwoordapparaat… week in week uit…
Uiteindelijk begin mei krijg ik iemand aan de lijn die het vreemd vindt dat wij nog niets geleverd hebben gekregen en beloofd het uit te zoeken en daarover te mailen. Uiteraard… niets!

Oplichters
Na bijna een half jaar is het ons wel duidelijk: dit wordt de eerste keer dat het misgaat…
De te bewandelen wegen binnen het Nederlandse rechtssysteem kennen we wel, echter dit betreft een Duits bedrijf… Ik besluit de zaak eens digitaal voor te leggen bij de Duitse politie. Na een week ontvang ik bericht van een hoofdcommissaris van politie in het betreffende district:

Als zuständige Dienststelle werden hier die Ermittlungen gegen die Fa. GSTW, 94267 Prackenbach,
Lindenweg 6, wegen Betrugs […] geführt. Die von Ihnen erstattete Anzeige reiht sich in eine ganze Serie von gleichgelagerten Betrugsfällen ein. Diesbezügliche Ermittlungen sind bereits bei der Staatsanwaltschaft Deggendorf anhängig.

Het is dus een bekende klant bij de politie en er loopt reeds een procedure tegen hen! Naja, jammer dan, weten we in ieder geval dat we de lampen elders kunnen gaan bestellen.

Incassodiensten
Na netjes alle bewijsstukken te hebben verzonden aan de Duitse politie, blijkt echter al snel dat de hoofdcommissaris zich persoonlijk lijkt hard te maken voor onze zaak. Hij neemt meerdere malen contact op met GSTW (vreemd genoeg krijgt hij hen schijnbaar wel te spreken):

Ich habe zwischenzeitlich mit Herrn Wolf von der Fa. GSTW gesprochen. Dieser versicherte mir, dass er sich umgehend mit Ihnen in Verbindung setzt. Bei der Überprüfung seiner Unterlagen habe er festgestellt, dass Ihre Bestellung, die bei der Fa. GSTW irgendwie untergegangen sei, noch offen
ist. Er würde sich um die Sache kümmern.

Uiteindelijk wordt ik gebeld door Herr Wolf van fa. GSTW met de vraag of ik de lampjes nog wil of liever het geld terugontvang. Aangezien ik de lampen inmiddels heb besteld bij Pricebreaker.be (onze andere buren), verzoek ik hem het geld over te maken. Ben benieuwd…

Tip: Doe aangifte bij de Duitse politie indien u dezelfde ervaringen heeft. Het blijkt zelfs dat reageren op dit blog soms al leidt tot actie van GSTW. Derhalve wordt het aangeraden om (in het Engels/Duits) een bericht achter te laten dat u n.a.v. dit artikel aangifte gaat doen, mogelijk hoort u binnen enkele dagen ineens van GSTW (en zoniet: aangifte doen!)….

Half juli ons geld retourontvangen!
Complimenten voor de Duitse polizei voor de uitstekende hulp in deze zaak!

De lampen overigens uiteindelijk besteld bij Pricebreaker (bij onze Belgische buren). Netjes geleverd (via Kiala) en uiteindelijk nog goedkoper dan in Duitsland ook!

we also had negative experiences with the company GSTW. We cancelled an order about lamps which obviously never were ready to ship to us.
Now we are waiting for a reimbursement of our money. Unfortunately we have paid the invoice in advance.

Too bad these people are still ‘in business’…
If you have the idea nothing is happening: please contact Pinzl Helmut of the Bayern Police (I just sent you his contact details by e-mail); he had direct contact with GSTW (I was unable to reach them) and managed to get our money refunded!

For Natalie it all turned out ok in the end:

“I still can’t believe it: I got my money back from the company GSTW, - without contacting the police.

We wrote several e-mails and faxes to them, without any reply. Finally we sent a registered letter to them, telling them that we would contact a lawyer if they would not refund the money. And luckily they sent back the money.

This experience shows me that I will never again pay an invoice in advance to a company which has such a bad reputation.”

Damn. Wish I had googled that company up before ordering… I sent them money like 3 weeks ago and just got an email that they received it. Still hoping it’ll work out, but those stories frighten me… :/

We are also having problems with this company. Our first order was okey but it took a long time to get the lamps (3weeks). Now with the second order we are not able to reach the people in the company. First we thought that they are on holiday but now I am suspicious. Toevallig vanmorgen bij “ervaringen met GSTW” gekeken op Google, en zo op deze site gekomen.
Ik heb inmiddels ook al uitermate slechte ervaringen met dit bedrijf via de Lampen OnLine Shop en zou graag de kontaktgegevens dan de betreffende duitse politie willen ontvangen.

Bedankt voor de informatie.
Ik heb dhr Helmut Pinzl een email gestuurd en hierin mijn probleem met de firma GSTW uitgelegd.
Omgaand werd mij nadere informatie gevraagd en al verteld dat er een “aanzienlijke” rij met identieke ervaringen aanwezig was.

Tot mijn verbazing werd ik enkele dagen daarna door dhr. Anton Wolff van GSTW zelf gebeld, terwijl ik inmiddels al een groot aantal emailtjes had gestuurd zonder ook maar enige reactie terug te krijgen. Hij vroeg mij, enigszins onnozel, wat mijn “probleem” was en beloofde mij aan het eind van het gesprek de ontbrekende delen alsnog direct op te sturen.
Twee dagen later werden deze missende onderdelen afgeleverd.

De “bemoeienis” van dhr Pinzl heeft zeker gewerkt; jammer dat je eerst deze stappen moet zetten.

Dom dom. Ook wij hebben een bestelling geplaatst bij GSTW - en delen de ervaringen die hierboven beschreven staan. Lijkt me dat ook wij de Duiste politieautoriteiten maar moeten inschakelen om nog iets van deze firma terug te horen. Op een andere wijze reageren ze toch niet. Zouden ook wij de contact details van Helmut Pinzl kunnen krijgen?

at 1st of November 2008 I ordered electrical parts at the Online Shop KNX Online Shop. I tried to contact them about different email addresses and about phone, but never got in contact with anyone. If you call them in the afternoon you’ll only reach the answering machine. I have switched my phone to the call back function, but when my phone rings nobody answered the phone.

Please give me your contact to the Bavarian police (Helmut Pinzl). I don’t understand, why German courts of law don’t forbid them to offer their products via internet. There are a lot of persons which have much problems with this company.

many thanks for giving your advice. The link above to german police have worked. I have received my money back. I’m so lucky.
Thanks also to Mr. Pinzl, the policeman of the year.
I have ordered some lamps in oktober and nothing happend after pay.
There was no answer from GSTW all the time.
After a short message to police in december, things changed.
Suddenly a email from GSTW and now I have got my money back.

Hallo,

ich habe die gleichen schlimmen Erfahrungen mit GSTW/ Lampen&Leuchten Online Shop/ EIB/KNX Online Shop gemacht: Geld losgeworden, keine Ware, keine Reaktion auf E-Mails, immer nur den Anrufbeantworter am Telefon.

Ich habe gestern bei der Polizei in Viechtach Anzeige wegen Betrugs gemacht. Heute hat sich die Polizei (Herr Pinzl) per E-Mail bei mir gemeldet, mir das Aktenzeichen mitgeteilt und nach weiteren Details gefragt.

Wer noch viel mehr schlimme Berichte von anderen Kunden lesen will: auf www.ciao.de gehen, Stichwort GSTW eingeben (ca. 25 Berichte).

Hoi Gyuri,

ik ben blij dat ik je blog heb ontdekt. Ik heb hetzelfde meegemaakt als de anderen hier: geld vooraf overgemaakt, de waar niet gekregen, geen antwoord op mijn e-mails, altijd maar het antwoordapparaat aan de lijn. Dankzij je informatie over je ervaringen (en die van de anderen schrijvers hier) heb ik beslissing genomen om aangifte te doen bij de politie in Viechtach. Gisteren de aangifte opgestuurt, vadaag al een antwoord van dhr Pinzl gekregen.

Hello,

I experienced the same as the others here with GSTW / Lampen & Leuchten Online Shop / EIB/KNX Online Shop; paid money in advance, didn’t get the merchandise, didn’t get any reply to my e-mails, always only the answering machine at the phone.

Encouraged by the information I found here, I yesterday pressed charges against the owner, Tamara Wolf, at the police in Viechtach. Today I already got an e-mail reply from the police who asked for more information.

Hello,

I ordered a big order from GSTW in the middle of February. When I had not recieved any message or products yesterday I sent them a letter. I got an reply in a few hours that said that they have insolvency problems and I have to send them more details about how much money I have sent them and when. They seem to have gone bankrupt. Anyone else that have recieved this message?

Hello Sandas. I ordered 20.1.2009 for 74€ and sent an registered letter to set them into default by 14.3.2009. I got no reaction from GSTW, neither a message, nor money back, and none of the ordered parts. Now their web site is offline.

Usually s/o initiates a gerichtliches Mahnverfahren (legal dunning procedure), but it is worthless if the company is bankrupt, they simply do not accept the reg. letter and you pay for nothing.

The only way is the police, accused Insolvenzverschleppung (delay in filing for insolvency), because Tamara Wolf will have to pay personally if this fact is ascertained.

Hello.

I have today recieved the following statement from the European Consumer Center. I find it very interesting to recieve it on the same day as any claims should be filed. Have anyone tried to claim anything from this bancruptcy?

“Hello XXX, finally I got a reply of the insolvency administrator. The insolvency procedure started the 18th of June at he Amtsgericht Deggendorf, register number: 1 IN 121/09. The insolvency administrator is the lawyer Dr. Helmut Holzapfel. The consumer can register his claim until the 7th of July at the insolvency administrator.”
